Ottawa has increased permanent residence application fees

On April 5, 2022, the Government of Canada announced that Immigration, Refugees and Citizenship Canada (IRCC) has increased application fees for all permanent residence (PR) applications, including economic, permit holder, family, and humanitarian classes. For the first time since 2002, IRCC increased PR fees in 2020 to account for inflation. According to the Government website, application fees are subject to increase every 2 years to adjust for inflation. In addition, the Federal Government supports a cost-effective approach to financing government programs, where individuals who receive the services and benefit directly from them are responsible for most of the costs.

British Columbia invited Skilled Immigration and Tech candidates in the new BCPNP draws

On April 5, 2022, the Government of British Columbia issued new invitations under the British Columbia Provincial Nominee Program (BCPNP) and invited qualified Skills Immigration candidates and Tech workers. The province invited 131 candidates under the Skilled Worker and Skilled Worker EEBC categories, International Graduate and International Graduate EEBC categories, as well as the Entry Level and Semi-Skilled category. The minimal score for candidates invited in these draws was between 77 and 125 points. In 2022, in total, British Columbia has invited 2,403 candidates.

Bureaucracy in Quebec slows the recruitment of foreign workers

Unlike other provinces, Quebec has an advantageous position and can facilitate the hiring of foreign workers in more than 200 in-demand professions under the Canada-Quebec Accord and the Canadian Constitution. An employer who decides to recruit a foreign worker must request the Federal Government to obtain a Labour Market Impact Assessment (LMIA) and then to the provincial government to get a Quebec Acceptance Certificate (CAQ). The problem is that CAQ can only be submitted by mail and be signed by workers living overseas, who usually do not understand French. Although Quebec has a simplified list to hire foreign workers, additional bureaucracy makes it harder for employers to involve new workers and solve the labour shortage issue.

Federal Court decided that it is unreasonable for a visa officer to consider recently issued reference letters inapplicable

On March 4, 2022, the Federal Court of Canada ruled that it is unreasonable for a visa officer to consider an applicant’s work experience inapplicable because of the recently issued supporting employer reference letters. The judge found out that the applicant provided all proof that he meets the job requirements, and the officer’s interview questions did not reasonably address his terms of employment or job duties. The judge allowed the application to proceed, and the matter had been remitted to a different officer for reconsideration.
